Terms of Service

By accessing or using matchex.io (the “Platform”), operated by LBS Capital LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform.

matchex is a market data and analytics platform that provides financial information, thematic scoring, news aggregation, and portfolio tools for publicly traded companies with sports revenue exposure. The Platform offers free and paid subscription tiers with varying levels of data access and features.

The information provided on matchex is for informational purposes only and does not constitute investment advice, financial advice, trading advice, or any other form of professional advice.

Nothing on the Platform should be construed as a recommendation to buy, sell, or hold any security. You should not make any investment decision based solely on information from matchex. Always conduct your own research and consult with a qualified financial advisor before making investment decisions.

Past performance of any security discussed on the Platform is not indicative of future results. Investing in securities involves risk, including the possible loss of principal.

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.

matchex offers the following subscription tiers:

• Free — Limited access to index universe companies, 30-day market data, and headlines
• Starter ($14.99/month) — Full company access, historical data, AI summaries, and up to 3 custom indices
• Pro ($59.99/month) — All Starter features plus unlimited custom indices. Additional features such as AI briefings, real-time data, and export capabilities may be added over time.

Paid subscriptions are billed monthly through Stripe. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months.

We reserve the right to modify pricing with 30 days’ notice. Price changes do not affect the current billing cycle.

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Platform
• Scrape, crawl, or use automated tools to extract data beyond normal API usage limits
• Redistribute, resell, or sublicense Platform data without our written consent
• Interfere with or disrupt the Platform’s infrastructure
• Impersonate another person or entity
• Upload malicious code or content

All content on the Platform, including but not limited to the design, text, graphics, logos, thematic scoring methodology, sub-theme classifications, and software, is the property of Matchex LLC or its licensors and is protected by intellectual property laws.

Market data displayed on the Platform is sourced from third-party providers (EODHD, Financial Modeling Prep, Finnhub) and is subject to their respective terms and licenses. News content is aggregated from public sources with attribution.

You may not reproduce, distribute, or create derivative works from Platform content without our express written permission.

We strive to provide accurate and timely financial data, but we do not guarantee the accuracy, completeness, or timeliness of any information on the Platform. Market data may be delayed, and thematic scores reflect our proprietary methodology which may not align with other assessments.

We are not responsible for errors, omissions, or delays in data, or for any actions taken based on such data.

To the maximum extent permitted by law, Matchex LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

• Your use or inability to use the Platform
• Any unauthorized access to your account
• Any errors or omissions in Platform content
• Any investment decisions made based on Platform information
• Any interruption or cessation of the Platform

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim.

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

You agree to indemnify and hold harmless Matchex LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

We may terminate or suspend your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections 3, 7, 9, 10, 11, 14, 15, and 17 survive termination.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on the Platform or sending an email to your registered address. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, pandemics, labor disputes, third-party service provider failures, or cyber attacks.

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Matchex LLC regarding your use of the Platform. These Terms supersede all prior agreements, representations, and understandings, whether written or oral.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

The failure of Matchex LLC to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Matchex LLC.
